This contract states the terms and conditions upon which Mario’s Manor (The Manor) will provide as a serviced apartment to their guests (Guests) as stated upon booking. This contract is between the Guest and Mario’s Manor.  Mario’s Manor is operated by Victor Village Apartments.

Definition

1. Mario’s Manor (The Manor). Name of the serviced apartment operated by Victor Village Apartments.

2. Guest(s). Person, customer, who pays for the services provided by the apartment.

3. Reservation. The arrangement for an accommodation unit in the Manor to  be kept or held back for the use of a particular person until the Booking is confirmed by the payment of the Deposit (Reservation).

4. Booking. A confirmed reservation for an accommodation at The Manor that specifies (books) the dates

5. Deposit (Reservation). The payment to keep the reservation

6. Security Deposit. An amount that secures partial coverage of soilage, damage or lost property of the Manor.

7. Arrival Date. Specified date of arrival of the Guest. Check-in time is from 1pm of the Arrival Date.

8. Departure Date. Specified date of departure of the Guest. Check-out time is before 12nn of the Departure Date.

9. Unit. Accommodation Type.
 
    a) Family Unit. This accommodation unit is fitted with a queen bed (60″x75″) and a bunk bed where a standard single size bed (36″x75″) is above a twin size bed (42″x75″)
 
    b) Group Unit. This accommodation unit is fitted with 3 bunk beds of standard single size beds (36″x75″).

10. Rates
   
   a)  Daily rates. 2188/night for duration of 3nights/4days to 5nights/6days.
   b)  Weekly rates.
         – Short week (up to 2weeks). 1988/night for a duration of 6nights/7days to 14nights/15days.
         – Long week (up to 3weeks). 1088/night for a duration of 15nights/16days to 21nights/22days.
   c)   Monthly rates(up to 2months).  888/night for duration more than 22nights/23days up to 60nights/61days.

Rates are subject to changes. The Manor reserves the right to change rates as deemed necessary within reason and may not make announcement prior to the effectivity of the change.

For duration of 15 nights up to 60 nights, Utilities such as Electricity and Water are charged separately and billed according to the actual consumption as indicated by the corresponding meters. Electricity and water rates are based on VECO (electric supplier) and MCWD (water supplier) rates.

11. Allowed Unit Capacity. The number of Guests allowed per Unit is limited to the number of beds. Queen and Twin beds are counted as 2guests/bed. Standard Single bed is counted as 1 guest.

12. Additional capacity.  An extra queen or standard single airbed or foamed (whichever is available) provided at additional cost.

Reservation and Booking Confirmation

1. Reservation.  To reserve Accommodation with Mario’s Manor we require 50% down payment or Deposit of the total rent due. This Deposit secures (reserves) you the Accommodation at the time of booking until the arrival date. Acknowledgement email and or text/chat/message will be sent to validate the Deposit. Should Reservation be cancelled 3days prior, 50% of the Deposit is forfeited.  

2. Booking Confirmation. To confirm the Booking, the balance due for the Accommodation must be paid no later than three days (3) days prior to Arrival Date, unless otherwise communicated with the Manor and agreed via email or message (text, messenger chat, Viber or Whatsapp) that payment of the balance will be done upon check-in.

For Bookings made within 7 days of arrival, full payment is required at the time of booking.

Booking Confirmation will be as follows:

    a) Booking by telephone: The Manor have confirmed acceptance of your payment and issued an acknowledgement email and/or text to the guest.

    b) Booking via mariosmanor website or email to mariosmanor email account: Guests receives an email confirming receipt of the payment.

Should the payment for the balance not reach The Manor within the required time stated, The Manor reserve the right to cancel the Booking and the Deposit (down payment) paid will be forfeited.

3. Method of Payment. The Manor accept the following methods of payment:

    a) Bank Transfer: BPI or MetroBank or Maybank. Bank details will be made available on request.
    b) Money Remittance Centers: Western Union, ML Money Padala, Palawan Money Express, LBC. Details of the remittance center will be made available on request.
    c) GCash: Account details will be made available on request.

4. Booking Extensions.  While every effort will be made to accommodate you, extending of booked dates are subject to availability and rate change.

A minimum of 3 days notice of intention to extend is required and full payment must be made for the number of extended days.

5. Accommodation Type.  Although Accommodation Type (Unit) is confirmed in advance, the exact Unit cannot be guaranteed prior to arrival. Guests will only have the right to occupy the Unit for the booked dates. Guests are only granted a license to occupy the Unit and this agreement gives Guests no other rights either express or implied to the Unit. We can therefore allocate a similar Unit if for whatever reason the Unit you have booked is not available on the day of arrival.

6. Occupancy.  The number of guests permitted to occupy each Unit is limited to the number of beds. The Manor reserve the right to charge for the extra bed, linens and towels for the additional guest. The Manor however does not permit overcrowding of the unit thus does not allow overnight stay of guests beyond the allocated capacity of each Unit.

7. Duty of Care/Responsibility.  It is the responsibility of the Guest to ensure they are respectful to other Guests in residence. Guests must also ensure noise levels are restricted. Reports of excess noise from other Guests will mean automatic and immediate termination of the stay. In addition, Guests have a responsibility and duty of care to ensure damage is not deliberately inflicted on the property or its contents. Smoking is prohibited and any evidence of this in the apartment will incur penalties. Pets are not allowed.  Any damages will be charged against the Security Deposit paid upon checking-in. Receipts for reworks,repairs or remedial works will be provided to the Guest in such instances where possible.

8. Arrivals and Departures.  Guests can check-in to their Unit from 1 pm of the Arrival Date.  Upon check-in, a Security Deposit of P1,500.00 is required to cover for partial cost should any part of the apartment building and the Unit be soiled or damaged or if Mario’s Manor property be lost (I.e. Linens, towels, electrical appliances, etc).  The Security Deposit  will be returned in full if there are no soilage, damages or lost items.  Check out is at 12nn of the Departure Date. Kindly note that there will be a charge of half a day for check-out after 3pm. 9. Booking Alterations.  Reserved Bookings may be altered subject to availability.

All alterations must be confirmed in writing. The Manor may charge, at its discretion, an amendment fee of P500.00 to cover the necessary administrative costs incurred. Guests will be obliged to pay any additional expenses incurred as a result of the alteration.

10. Cancellations.  All cancellations must be confirmed in writing. Notice period required is up to 2 days (48hrs) before check-in date. Any refund of payment is made subject to the apartment being re-booked.

11. Refunds.  Please note that all refunds will be issued a check. No other form of refund will be provided. Refunds will only be made once documents supporting the refund are turned in to The Manor together with all the keys and borrowed items (where applicable).

12.   Early Departures.  In the event that a guest needs to check out prior to the agreed departure date, The Manor will make a refund of accommodation charges for the remainder of the stay. However, any refund will be subject to the apartment being re-booked and will be subject to a cancellation charge of 1088.00


Bookings may be terminated to an earlier date or extended to a later date, but not more than 60days total length of occupancy.  The Manor must be informed, where possible, 3 days before the requested new Departure Date.  For early Departure Date, any refund of payment is made subject to the Unit being re-booked. For later Departure Date, full payment must be made for the number of extended days.

13. Inventory / Property Care.  A P1500,00 security deposit is required to cover soilage, damages or loss in the apartment. The Manor reserves the right to deduct from that deposit all amounts chargeable in accordance with section ‘Additional Charges’. The Manor reserves the right to charge the company or individual who made the booking.

14. Additional Charges.  WiFi is available free and password will be provided on check in. The Manor will not be responsible for any fault associated with the user’s hardware or software and no support will be available nor will The Manor be responsible for the unservice (slow or intermittent disconnection) of the WiFi provider. Th Manor will not provide compensation in any form for its failure to work.  The Manor cannot provide any guarantees that they will work with the user’s hardware or software.The Manor cannot guarantee their use and will not be responsible for their failure to work nor will they provide any form of compensation. Our assistance in respect of any problems will be limited to our contacting the service provider and only during office hours i.e. between 9.30 a.m. to 6 p.m. and will not be considered an emergency. Please note that download of excessive amounts of data, will be the guest’s responsibility and cost.  A notification and an invoice for the relevant amount shall be provided at the time of  at time of booking or at check-in.

Additional Chargeable Services:  Details of additional services are available on request. The cost of any such services is payable directly to the service provider.

15 .Cleaning. The Manor expects the units to be vacated cleaned/cleared and in good state upon check out. If, at The Manor’s discretion, additional cleaning is required on departure, the cost of this cleaning will be an additional charge.

16. Smoking.  Executive Order No. 26 (EO 26), otherwise known as the Nationwide Smoking Ban prohibits smoking in all units and communal areas. Guests found to be smoking or evidence of smoking in the Unit or communal areas will incur aP1000.00 charge by way of Liability to cover the additional costs of cleaning, freshening and airing the units over a 24 hour period. Any soil or damages caused will be charged for in addition to this fee.

Excessive use of water and Electricity: Kindly note where it is deemed that the use of water and electricity has been abused, an additional charge will be made.

17. Soilage/Damages.  A refundable damage deposit of P1500.00 is due upon check-in. This will be refunded following housekeeping report after checkout.  Damages to the apartment must be paid in full by the guest. In the event of any soilage, damage or extra cleaning required after the guest vacates, The Manor will notify guest, providing a detailed breakdown of the issues and the cost of rectifying them. Photographic evidence will also be supplied to the Guest, where possible.

Inventories and condition reports may be provided on request at the beginning and at the end of the accommodation period if required.

18. Keys.  The Manor will issue the guest with one set of keys. Additional sets can be supplied subject to availability and the request must be made in advance of arrival. Unreturned keys on check-out will be charged a cost for replacement of keys or changing of the locks. The cost of replacement keys will be P300.00 The cost for replacing the locks will be no less than P1000.00.   

19. Parking.  Parking is subject to availability of the parking slots.

21. Call Outs.  If the emergency call out number is used to call out The Manor staff between the hours of 10 pm and 8 am for any purpose other than an emergency, The Manor reserve the right to charge the booker/agent or guest a call out fee of P500.

22. Lost Property.  Any items left in the apartment will be kept for 1 month after the departure date. After that date The Manor reserve the right to dispose of the property as it sees fit.

23. Rates.  All rates quoted are based on the rates prevailing at the time that a booking is confirmed. Once a booking has been confirmed The Manor will not change the rate quoted unless there’s an Alteration on  the Booking. Prevailing Tax rate is charged at the rate in force at the time of invoicing. Rates are subject to change without notice and may vary for currency exchange movements where applicable between the Philippines and overseas locations.

24. Liability.  The Manor cannot be held responsible in any way for loss of or damage to, contents, furniture, fittings or any other  personal effects of the guests whilst in residence nor can the Manor be held liable for the acts or defaults caused by third parties.

Nothing in this contract seeks to exclude liability for death and personal injury or any other liability not excludable under Philippine  laws.

25. Access to Properties.  In addition to the weekly housekeeping service, The Manor on occasion may need to access the Unit in which the Guest is staying. The Manor reserve the right to gain access to all Units at all times. We will, wherever possible, endeavor to give guests as much notice as possible prior to entering the Unit.

26. Pets.  The Manor regret that pets are not allowed in the apartments.

27. Complaints.  The Manor makes every effort to ensure our guests have an enjoyable stay. In the event that you are not entirely satisfied with the service offered, you should notify The Manor as soon as possible.

28. Services. The following services below may be availed with additional cost. Approach The Manor staff to arrange for the service you request.

    a) Extra housekeeping
    b) Breakfast
    c) Snacks/Meals
    d) Laundry
    e) Arrival/Departure Transport
    f) WiFi additional Data

The Manor cannot be held responsible for any failure or interruption of services to the apartment, including electricity and water or any damage, disruption or noise caused as a result of repair works being carried out in another part of the property.

29. Restrictions.  There are a number of restrictions at certain Units and parts of the apartment building. Full details are available on request. Should guests be in breach of these terms and conditions, The Manor reserve the right to request that guests vacate the apartment within 24 hours.

30. Entire Agreement.  This Agreement shall be governed by the laws of the Republic of the Philippines and the Parties submit to the exclusive jurisdiction of the Philippine Courts and the Apartment Form is the complete and exclusive statement of the Agreement between the parties relating to the subject matter of the Agreement which supersedes all previous communications, agreements or other arrangements written or oral.  It is expressly agrees that no variation of this Agreement shall be effective unless in writing and signed by a duly authorized signatory of both parties.
